Comment to Todd Blanche, Acting Attorney General United States Department of Justice (DOJ) re: Proposed Rulemaking Review of State Bar Complaints and Allegations Against Department of Justice Attorneys by Lawyers for the Rule of Law (LFRL).
LFRL's objections to the Proposed Rule are straightforward. First, the former Attorney General and the DOJ lack authority to promulgate this proposed rule. Second, if promulgated, its enforcement would violate an act of Congress, namely the McDade Amendment, 10 and principles of federalism as reflected in the Tenth Amendment. 11 Third, by seeking to insulate all DOJ attorneys from external accountability for their conduct, the Proposed Rule would accelerate the ongoing erosion of public confidence in both the DOJ and in the criminal justice system itself.
