Statement from Kahn Law Firm, LLP on the 250th anniversary of the United States of America

 

As we justifiably revel in the eloquent proclamations associated with the 250" anniversary of our United States of America,we must appreciate and take great pride in the courage and foresight of the men who placed their signatures on that document and as they stated“... [W]e mutually pledge to each other our Lives,our Fortunes, and our sacred Honor.”

To these pioneers of independence and freedom, courage was no stranger. That same courage has continued over the centuries in our armed forces and those who stand up for freedom.

The Declaration of Independence stated many ideals and “truths” not yet recognized or acted on. One that stands out saliently is “[T[hat all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among those are Life, Liberty and the Pursuit of Happiness.”

We know many of the signers were owners of slaves; yet, slavery was not officially abolished until after the Civil War, and aspects of slavery persisted with Jim Crow laws and customs well into the 20" Century. The Cherokees were uprooted and driven from their ancient lands. Women’s rights were not recognized. There are more historical rights “hiccups” as well.

Nevertheless, the Declaration of Independence, much like the moral compass from Sinai embodied in the Ten Commandments, articulated a code of conduct that guides us to this day. When the Declaration was combined with the Constitution, adopted in 1789, and strengthened with the first Ten Amendments, known as the Bill of Rights, the pathway to a Great America that recognized, respected and enforced the rule of law with important freedoms was established.

History has made it clear the pathway to the true freedom and democracy we so deeply care about must be recognized, energized and fought for in every generation.

This requires vigilance, effort, speaking out and other actions, with civility, to assure the America we love and cherish does not regress into a status of experiencing many of the arbitrary wrongs complained of in the Declaration of Independence attributed to King Charles III and his minions as we view and experience many present day governmental actions and activities inconsistent with and contrary to respect for the rule of law, constitutional norms and the lofty ideals so eloquently expressed 250 years ago.

For example, Lady Liberty’s light has been dimmed by attacks on judges and the judicial system. We have witnessed episodes when the “due” has been diminished or taken out of “due process of law.” Unfortunately, other examples abound.

We must be mindful of what Ben Franklin said when asked if the Constitutional Convention created a republic or a monarchy. He said: “A Republic, if you can keep it.”- That is our charge. That is our obligation. That is our critical mandate.

I hope and trust we will continue to have the strength, wisdom and determination to follow through to assure the well springs of our democracy continue to nourish America’s greatness. Nothing less is or should be acceptable.
